, and vote for board members + proposed neighborhood rental restrictions revision (info below). Hi everyone,

I am Russ Gordon the President of the Oak Tree Farm board. We are having elections this year not only for four of the board members (Bill Dunn | Tricia McCubbins | Sharon Jegen | Andrea Burkhart) but also for a changing of the restriction regarding rental properties.

Voting will be done at the FOB nights when there is a notary at the clubhouse.  Amendment  18 Will be replaced with a new amendment 18 that will have three differences from the old one.

The first difference is any person or entity which purchases or otherwise acquires title to a lot in Oak tree farm is prohibited from leasing or renting the structure on that lot this provision does not apply to owners who acquired a lot before January 1, 2023.  What this means is all existing homeowners are free to rent their homes and this restriction does not apply to them, just future homeowners.

The second change to the amendment is regarding temporary and short-term tenancy. No dwelling unit within oak tree farms subdivision shall be used for transit hotel fee, for temporary residential use or short term rental in other words no VRBO's and/or Airbnb's, which said short term rental shall be defined herein as a rental, temporary residential use for any period less than one year.

The third change goes along with a second in that any lease agreement must be a minimum of one year unless specifically approved in advance by the homeowners association Board of Directors in writing, which shall be based upon extra ordinary circumstances including for example but not limited to active military deployment, job transfer etc.  Failure by any tenant under a lease agreement to comply with any and all rules and regulations, restrictive covenant, and/or homeowners association governing documents may result in fines against the owner which can be collected as annual homeowner association dues/assessments. The homeowners association may take direct action against the tenant to terminate a tenancy and lease agreement. Association may charge the cost, expenses and attorneys fees incurred in action taken to terminate a tenancy and Lease agreement against the owner and property as additional assessments/dues.

Additionally, you will be able to pay any outstanding dues and sign your pool agreement, both of which are required for your fob to be activated.
